The main goal of probate proceedings is to identify the heirs, the assets, and the rights that belong to the heirs and other entitled persons. When there are no disputed elements, the probate process is brief, and a decision on inheritance is issued within a short period of time. However, if a dispute arises among the heirs, the probate proceedings are suspended, and the parties are referred to civil litigation. In such cases, the process may become lengthy and costly for those involved.
The most common civil proceedings arising from probate proceedings are:
  • Challenging the existence of a will
  • Establishing the existence of a will
  • Exclusion of property from the estate
  • Determination of the compulsory (forced) share (in cases where the decedent, during their lifetime, disposed of real estate by gifting it to third parties who are not legal heirs entitled to a compulsory share, or when such property was transferred to other heirs entitled to a compulsory share in a proportion exceeding that prescribed by law)
